Most recipients of California’s In-Home Supportive Services (IHSS) (“IHSS consumers”) will face a 3.6% reduction in IHSS hours starting February 1, 2011.
Some IHSS consumers will need to advise providers of the cuts and where they want them made while others have received notices that contained an inaccurate calculation of total authorized need.
This cutback is a result of a legislative change that took place in 2010, AB 1612, which added WIC Section 12301.06.
The National Senior Citizens Law Center has developed an IHSS Advocate Alert that contains how the reduction will be applied, explains how cuts for those who receive maximum hours work and what local advocates can do to help IHSS consumers navigate the change. It also includes information on how to appeal an assessment.
Read the IHSS Hours Reduction Alert. A parallel consumer handout on this topic is available from Legal Services of Northern California, at http://www.lsnc.net/fact_sheets/IHSS_3.6_flyer_3.pdf. Translations of the consumer handout are available in Spanish, Chinese, Armenian, Vietnamese and Russian and are available at http://www.lsnc.net/calworks-welfare-resources/.
